Thoughtful Estate Planning to Protect What Matters Most

Whether you worked hard and bought a home and built a nest egg, or were lucky enough to win big in the lottery, or simply inherited assets from a relative, it is essential you have the proper documents to make sure that your wishes as to lifetime decisions such as healthcare, the management of your assets and final disposition of your assets upon death, are known in the event you become physically or mentally incapacitated or if you should die.  There is no one estate plan that fits everyone. 

After reviewing our clients’ family dynamic, their assets, what they would like done with said assets if they become physically or mentally incapacitated, who will handle their assets and act on their behalf as to their medical wishes and where their assets are to go when they die and who will be responsible for marshalling (i.e. collecting) the clients’ assets and managing and/or distributing said assets  in accordance with the clients’ documented wishes; I am able to advise the client as to what estate plan documents they will need.  We advise and prepare estate plan documents for small, mid-size and large estates.

A basic Estate Plan will typically include a Health Care Proxy, a Durable Power of Attorney (which once executed pursuant to statute is effective until the client either revokes them in the prescribed manner or the client dies), and a Last Will and Testament (hereinafter referred to as “a Will”).  Based upon discussions with the client the estate plan may also require Testamentary Trust(s) (i.e. Trust(s) within a Will) such as a Minor’s Trust or non-Testamentary Revocable or Irrevocable Trusts, including, but not limited to Qualified Personal Residence Trusts, Irrevocable Life Insurance Trusts or Special Needs Trusts.  (Please note that are too many different types of Trusts to list in the limited space provided).
